HITV — Terms of Service

Effective Date: August 21, 2025

These Terms of Service (“Terms”) govern your access to and use of the HITV mobile application, website, and related services (collectively, the “Service”). By creating an account, downloading, or using the Service, you agree to be bound by these Terms.

1. Who we are

“HITV,” “we,” “us,” or “our” refers to the provider of the Service. If you have questions about these Terms, contact us at Gehloteshaam@icloud.com.

2. Eligibility and account

• You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service.
• You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.
• You will promptly notify us at Gehloteshaam@icloud.com of any unauthorized use of your account.

3. License and acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You agree not to, and not to permit others to:

• Copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by law;
• Reverse engineer or attempt to extract the source code except where permitted by applicable law;
• Bypass or interfere with security or access controls;
• Use the Service to infringe the rights of others or to upload unlawful, infringing, harmful, or deceptive content;
• Use automated means (bots, scrapers) that burden or disrupt the Service.

4. Content and intellectual property

• All rights in and to the Service, including text, graphics, user interface, design, and software, are owned by HITV or its licensors and are protected by intellectual property laws.
• Where the Service enables user-generated content, you grant HITV a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display such content solely for operating and improving the Service.
• You are responsible for the content you submit and must have all necessary rights to it.

5. Third-party services and content

The Service may integrate third-party services, SDKs, or content. HITV is not responsible for third-party websites or services and your use of them may be subject to separate terms and policies.

6. Subscriptions and purchases

Some features are available through paid subscriptions or in‑app purchases processed by the app marketplace (e.g., Apple App Store). Billing, renewals, and cancellations are governed by our Membership (Subscription) Terms and Auto-Renewal Terms, and by the marketplace’s own terms and policies.

7. Changes to the Service

We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice, including by adding or removing features.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms or if required by law. Upon termination, the rights and licenses granted to you will end.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITV DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error‑free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITV AND ITS AFFILIATES, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. Our aggregate liability for any claim will not exceed the amount you paid (if any) for the Service in the twelve (12) months preceding the claim.

11. Indemnity

You agree to indemnify and hold harmless HITV from and against any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Service.

12. Governing law; disputes

These Terms are governed by the laws applicable in your country or state of residence, without regard to conflict-of-laws principles. Any disputes will be resolved by the competent courts in that jurisdiction unless applicable law provides you with consumer forum rights that require otherwise.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Effective Date” above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
